DocuSign Faces Lawsuit Over Alleged Violations of Digital Privacy Laws

Lawsuit Alleges DocuSign Violated California Digital Privacy Law with Tracking Software on Website

The software company DocuSign is facing a lawsuit in California for allegedly violating state digital privacy laws by using tracking software on its website. The lawsuit, filed by consumer privacy advocate Milita Casillas, claims that DocuSign used “pen register” and “trap and trace” technology to identify users and their locations without their consent.

According to court documents, the tracking software collected and processed data from website visitors, including personal information such as names, addresses, and even interests. Casillas, who works as a tester to ensure companies comply with privacy laws, hopes to educate the public about illegal conduct and advance consumer protection statutes through the lawsuit.

Scott Ferrell, the attorney representing Casillas, stated that the primary goal of the lawsuit is to expose the unlawful conduct of companies using intrusive software to track website visitors. He emphasized that such conduct is illegal in California without a warrant, and that companies must abide by state privacy laws.

Casillas is seeking statutory and punitive damages, as well as attorney fees, from DocuSign. If the company refuses to stop its alleged unlawful conduct, she plans to amend the complaint to include additional plaintiffs or class allegations. As of now, counsel for DocuSign has not made an appearance, and a request for comment from the company remains unanswered.

This lawsuit is part of a larger trend of digital privacy suits under the California Invasion of Privacy Act, with several companies facing similar allegations in recent months. It remains to be seen how DocuSign will respond to the lawsuit and whether it will change its practices in light of the allegations.
