New Data Privacy Law in Maryland: The Latest State to Join the Trend
In a world where data protection laws are becoming the norm, Maryland has taken a significant step by enacting the Maryland Online Data Privacy Act of 2024 (MODPA). This makes Maryland the latest state to adopt a comprehensive data privacy law, joining a growing number of states that are taking action to protect their residents’ personal information.
The MODPA, signed into law by Governor Wes Moore on May 9, 2024, sets strict parameters for companies conducting business in the state or targeting Maryland residents. Companies that control or process the personal data of at least 35,000 consumers or derive more than 20% of their revenue from the sale of personal data are subject to the law’s provisions.
Similar to other state regulations, the MODPA grants Maryland residents rights such as access, rectification, erasure, and data portability. Additionally, residents have the right to opt-out of targeted advertising, the sale of personal data, and profiling for automated decisions with legal implications.
With Maryland joining the ranks of states with data privacy laws, the total number of states with such legislation will reach 18 by January 2026. While these laws aim to provide enhanced protections for consumers, they also present challenges for companies operating across multiple states due to variations in requirements.
As the trend for data protection laws continues to grow, there is hope for a federal law in the United States to bring consistency and clarity to the data privacy landscape. Such a law would not only benefit consumers but also help companies ensure compliance and build trust in their data processing practices.
